Terms used in this site
Pit Bike Parts is a trading name used by the registered company Villain-X Limited. The words ‘Pit Bike Parts’ and ‘Villain-X Limited’ may be used interchangeably throughout this site and its terms.
Throughout this site and all terms contained within, the term Seller shall refer to the store pitbikeparts.co.nz, the trading name of Villain-X Limited. The term Buyer shall refer to any legal entity purchasing goods and/or services from the seller.
Contracts of Sale and Purchase
All terms of trade stated anywhere within the Pit Bike Parts website or other Pit Bike Parts document shall apply to all invoices issued by Pit Bike Parts unless amended in writing by a legal representative of Pit Bike Parts.
Pursuant to any purchase order placed on Pit Bike Parts (offer to buy), the buyer accepts all terms and conditions contained herein. No additional or contrary condition stated with a buyers order shall be considered accepted by Pit Bike Parts unless such acceptance has been expressed to the buyer in writing.
In dispatching the buyers order for delivery (arising at the time the goods pass to the carrier for delivery to the buyer) the seller accepts the buyers offer to buy in accordance with the terms and conditions expressed in this website and other Pit Bike Parts documentation, and a contract of sale between the buyer and seller has been formed.
Any cancellation, waiver or variation of the buyer's order shall not effect the sale agreement unless accepted in writing by the seller.

Title of Goods
Title of the goods will pass from the seller to the buyer at such time as the goods are passed from the seller, or the seller’s supplier, to the buyer, or the agent charged with delivering the goods to the buyer. Note that goods will not be passed to the buyer or any agent for pickup or delivery until such time as payment in full has been received by Pit Bike Parts for the goods in question. Until such time the goods remain the property of Pit Bike Parts.
Risk and Insurance
Risk and Responsibility for the goods passes to the buyer once the goods have been passed to the carrier by Pit Bike Parts for delivery to the buyer (after full payment of the invoice). Insurance liability, both for transporting with the carrier and at all times thereafter, lies therefore with the buyer.
Pit Bike Parts will Not Be Liable for:
Any item not included in a purchase from Pit Bike Parts to the user. This includes, but does not limit to, any additional component/hardware or accessory purchased and connected to the original items subsequent to the purchase of the original items, unless purchased from Pit Bike Parts.
Any faults arising from the improper installation and connection of items/component items by customers. Please read the product manuals for full installation instructions, or commission the use of a professional installation and tuning service.
Any items or components thereof no longer under warranty; out-of-warranty repair costs are the sole responsibility of the buyer.
Any damage caused as a direct result of any item supplied by Pit Bike Parts.
Any items where the user has used the product/s in an abusive or negligent manner
Pit Bike Parts reserves the right to retain goods for the purpose of analysis and repair under warranty conditions. All repairs will be conducted in a reasonable time.
The seller accepts no liability for any direct or indirect loss or damage to the buyer arising from or in connection with any delivery delays or performance failures or shortcomings relative to the contract of sale between buyer and seller where failure to perform any term of said contract is caused directly or indirectly by an act of God, fire, armed conflict, labour dispute, civil commotion, intervention of a government, inability to obtain labour, materials or facilities and accidents, interruptions of, or delay in transportation or any other cause beyond the seller's control.
Minimum Orders
Pit Bike Parts reserves the right to limit the number of ‘sale’ items purchased per customer.
